ペンディ 利用規約

1. 適用
本規約は、ペンディの利用条件を定めるものであり、利用者は本規約に同意したうえでサービスを利用するものとします。
2. アカウント
- Apple／Google サインインまたは匿名アカウントで利用できます。
- ログイン情報は利用者が責任を持って管理し、第三者への貸与・譲渡を禁止します。
3. サブスクリプション
- プラン名：ペンディ プロ（Pro プラン）。
- 提供内容：ノート作成・YouTube 取り込み・音声取り込み・AI 質問・要約の編集について、無料プランの利用回数制限を解除します。あわせて、11 枚以上のフラッシュカードおよび 11 問以上のクイズの生成、クイズの作り直し、コミュニティで公開されたノートの保存がご利用いただけます。
- 料金と期間：1週間プラン（¥980／週）、月額プラン（¥1,500／月）、年額プラン（¥8,000／年）。いずれも日本での価格で、自動更新です。価格は国・地域により異なり、各プランの最新価格は App 内の購入画面に表示されます。
- 無料トライアル：1週間プランと月額プランには、それぞれ7日間の無料トライアルが付与されます。無料期間中は料金は発生しませんが、期間終了の24時間前までに解約しない限り、自動更新され料金が請求されます。年額プランには無料トライアルはありません。無料トライアルのご利用は1アカウントにつき1回限りで、1週間プランと月額プランのいずれか一方でご利用いただけます。
- 自動更新：期間終了の 24 時間前までに App Store の設定から解約しない限り、同一期間で自動更新され、更新時に料金が請求されます。
4. 解約方法
解約・プラン変更は、利用者が App Store のアカウント設定から行ってください。アプリ内では解約操作はできません。
5. 返金ポリシー
返金は App Store のポリシーに従います。当方では直接返金対応を行いません。
6. サブスクリプション変更・解約時のデータ取り扱い
解約後も利用者のノートや生成コンテンツは保持され、無料プランの範囲内で閲覧できます。ただし、一定期間利用がない場合や退会処理を行った場合は、ポリシーに従い削除されることがあります。
7. コンテンツの利用
- 利用者がアップロードしたコンテンツの権利は利用者に帰属します。
- 当方はサービス提供・改善の目的に限り、当該コンテンツを解析・処理できます。
- 法令や公序良俗に反するコンテンツのアップロードは禁止します。
8. 禁止事項
- アプリのリバースエンジニアリング、スクレイピング、過度な負荷を与える行為。
- 他者の権利を侵害する行為、虚偽情報の登録、スパム行為。
- 不正アクセスや不具合利用などサービス運営を妨げる行為。
9. 免責事項
本アプリは現状有姿で提供されます。外部サービスの障害や通信環境に起因する損害について、法令で義務付けられる範囲を除き責任を負いません。
10. 利用停止・解除
規約違反や不正利用が判明した場合、通知なくアカウント停止・削除を行うことがあります。利用者は設定画面またはストア経由で自主的に退会できます。
11. 規約の変更
本規約は必要に応じて改定されます。重要な変更を行う場合は、アプリ内通知やメールで告知します。変更後にサービスを継続利用した場合、改定に同意したものとみなします。
12. 準拠法・管轄
本規約は日本法に準拠し、紛争が生じた場合は東京地方裁判所を第一審の専属的合意管轄裁判所とします。

公開投稿・モデレーション
利用者は公開する内容について責任を負い、他者の権利を侵害する内容や安全を脅かす内容を投稿してはなりません。当方は、通報または安全上の必要に応じて公開内容を確認し、事前通知なく削除・公開停止・利用制限を行うことがあります。虚偽または濫用的な通報も禁止します。
カスタムコミュニティの安全
公開・招待制を問わず、カスタムコミュニティの名称と説明はユーザー生成コンテンツとして同じ安全規約の対象です。招待制コミュニティの内容はメンバーだけが閲覧できますが、安全規約の対象外にはなりません。非オーナーメンバーはコミュニティまたは作成者を通報・ブロックできます。通報は原則24時間以内に確認します。
Pendy Terms of Service

1. Application
These terms define the conditions for using Pendy, and users agree to these terms when using the service.
2. Account
- You can use the service with Apple/Google sign-in or an anonymous account.
- Users are responsible for managing login information and are prohibited from lending or transferring it to third parties.
3. Subscription
- Plan Name: Pendy Pro (Pro Plan).
- Features: Removes the free plan's usage limits on note creation, YouTube import, audio import, AI questions, and summary editing. It also allows generating more than 10 flashcards or more than 10 quiz questions, regenerating quizzes, and saving notes shared in the community.
- Pricing and Period: 1-week plan (¥980/week), monthly plan (¥1,500/month), annual plan (¥8,000/year). These are the prices in Japan, and all plans auto-renew. Prices vary by country/region, and the latest price for each plan is shown on the in-app purchase screen.
- Free Trial: The 1-week plan includes a 7-day free trial. No charges apply during the free period, but unless canceled 24 hours before the period ends, it will auto-renew and charges will apply. The monthly and annual plans do not include free trials.
- Auto-Renewal: Unless canceled from App Store settings 24 hours before the period ends, it will auto-renew for the same period and charges will apply upon renewal.
4. Cancellation Method
Cancellation and plan changes must be done by users from their App Store account settings. Cancellation cannot be performed within the app.
5. Refund Policy
Refunds follow the App Store's policy. We do not handle refunds directly.
6. Data Handling upon Subscription Change/Cancellation
Even after cancellation, users' notes and generated content are retained and can be viewed within the free plan limits. However, content may be deleted in accordance with our policy if there is no usage for a certain period or if account deletion is processed.
7. Content Usage
- Rights to content uploaded by users belong to the users.
- We may analyze and process such content only for the purpose of service provision and improvement.
- Uploading content that violates laws or public order and morals is prohibited.
8. Prohibited Activities
- Reverse engineering of the app, scraping, or actions that place excessive load on the service.
- Actions that infringe on others' rights, registration of false information, or spam activities.
- Unauthorized access, exploitation of bugs, or other actions that interfere with service operation.
9. Disclaimer
This app is provided as-is. We are not responsible for damages caused by external service failures or communication environment issues, except as required by law.
10. Suspension/Termination
If terms violations or unauthorized use are discovered, we may suspend or delete accounts without notice. Users can voluntarily cancel through the settings screen or stores.
11. Terms Changes
These terms may be revised as necessary. When making significant changes, we will notify users through in-app notifications or email. Continued use of the service after changes constitutes agreement to the revisions.
12. Governing Law and Jurisdiction
These terms are governed by Japanese law, and disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

Public posts and moderation
You are responsible for content you publish and must not post material that infringes others’ rights or threatens safety. Following a report or when needed for safety, we may review content and remove it, restrict its visibility, or limit access without prior notice. False or abusive reporting is also prohibited.
Custom community safety
Names and descriptions of custom communities are user-generated content and follow the same safety rules whether the community is public or invite-only. Invite-only content is visible only to members, but it is not exempt from these rules. Non-owner members can report the community or creator and block the creator. We aim to review reports within 24 hours.
